Understanding the legalities of privacy glass and its various forms is key in preventing any safety issues and police attention that can lead to legal repercussions.
In this blog, we will explore the question ‘Is privacy glass legal in the UK? Rules and regulations you need to know’
With a thriving aftermarket industry, it’s no secret that vehicle owners want the best for their vehicles, whether it’s making it look the way they want it and/or making upgrades. Either way, having peace of mind is the most important factor, this can only be provided by established and trusted service providers like GoTints!
Can factory-made privacy glass be illegal?
Not exactly. Vehicle manufacturers in the UK, or a privacy glass manufacturer in the UK, must ensure their privacy glass adheres to the legal tint regulations for the respective car windows.
However, if a vehicle manufactured with privacy glass is imported from abroad, this has the potential to violate legal regulations if used on public roads. This is due to tinting regulations being varied across the world.
What makes privacy glass illegal?
Privacy glass follows window tinting rules, in that there are restrictions for front and front side windows, and no restriction for rear windows.
Simply put, if your front and front side windows allow at least 70% of light to enter, they are legal. Older vehicles (that are first used before April 1st 1985) must allow 75% of light to enter the front and front side windows.
This means, whether you have factory installed privacy glass, or a window tint film applied to your rear windows, it can be as dark as you want it to be.
Can the police stop me for a dark rear window tint?
As a rear window tint isn’t restricted by law, a police officer stopping you specifically for your rear window tints is unlawful.
However, police have powers to stop individuals under reasonable suspicions. This means if your front window tints are noticeably darker, they may lawfully stop the vehicle to test the front tints to ensure they are compliant.
Police officers are equipped with light-measuring devices to accurately determine the level of window tint.
What happens if I have an illegal tint?
If the police have measured your tint and determined it is illegal, they have a number of powers they can implement afterwards. These are:
Prohibition notice:
This is a notice which legally prevents the driver from using the vehicle whatsoever on a public road until the tint has been removed. If caught driving without removal, you can face further action.
Fixed penalty notice:
A fixed penalty notice is a fine that must be paid by a certain date. This can increase if neglected.
Penalty points:
Penalty points may also be added to the driving licence in addition to the fixed penalty notice.
Court summons:
In more serious cases, specifically for repeat offenders or if the driver ignores a prohibition notice, the police may issue a court summons. This can lead to higher fines and further legal consequences.
Requirement to rectify:
In some cases, police may give the driver a certain amount of time to remove the illegal tint.
Why is privacy glass allowed if they can be illegal?
The benefits of privacy glass/tinting on vehicles outweighs the issues it can cause, only if it is used responsibly.
The main issue is visibility, a driver with an illegal tint will have more trouble navigating in very low light conditions, making them a danger to themselves and other road users.
However, if the regulations are adhered to, it becomes much less of an issue.
Can window tints be added onto privacy glass?
In some cases, yes. Some vehicles are manufactured with privacy glass. For front, and front side windows that already have privacy glass applied from a manufacturer, you must find out the VLT levels of the privacy glass first.
By doing this, they can ascertain the appropriate tint to apply, this prevents the two tints from going over the legal threshold.
Is privacy glass more durable than a window tint?
Yes. Privacy glass is more durable than a window tint, though it depends on what aspect of “durability” you are referring to. Here’s an explanation:
Privacy Glass
Durability of the tint:
The tint itself is extremely durable. It’s integrated into the glass during manufacturing, so it cannot peel, bubble, scratch, or fade in the same way that a film can.
Durability of the glass:
Privacy glass is essentially standard automotive glass with a tint integrated into it. Its inherent durability is the same as any other automotive glass. It can still be broken or chipped.
Window tint:
Durability of film:
The durability of a tint film varies significantly depending on the quality of the film and the installation itself. High-quality films are designed to resist scratching, fading, and bubbling, but they are still susceptible to damage from sharp objects or improper cleaning practices.
Durability of the glass:
Surprisingly, the tint film itself adds a nominal amount of durability to the window. This is by holding shattered glass together. However, it does not necessarily make the glass harder to break.
Comparing the two options
Tint durability:
Because privacy glass is integrated within the window itself, its tint has a superior durability, and is subject to the state of the window itself. Whereas a tinting film is subject to the quality of the tint provided, installation and cleaning practices.
Overall glass durability:
There is no difference in terms of the durability of the privacy glass and the tinted window, they are both subject to damage with the same amount of stress.
Can I apply privacy glass or tints to a leased vehicle?
In most cases, no. Any aftermarket customisation to a vehicle that isn’t yours, requires express permission from the vehicle owner, whether it’s another individual, leasing company, etc.
Leasing companies require clients to sign an agreement, customisations may violate these agreements. Always check with the lease provider before making any changes to the vehicle.
If you continue with these customisations, you will likely be held liable for removal and other costs, whilst voiding your contract, leaving you without a vehicle.
